A family that participates in the Section 8 Housing Choice Voucher Program (HCVP) has two sets of obligation—those set out in the family’s lease with the landlord, and those set out in Section 4 of the family’s HCVP Voucher (the contract between HACA and the HCVP family that entitles the family to participate in the HCVP program). The responsibilities set out in Section 4 of the family’s HCVP Voucher are supplemented by those set forth in HACA’s Obligations of the Family form.
The landlord is responsible for insuring that the Section 8 family does not violate the lease. If HACA becomes aware that tenant lease violations are occurring, HACA works with the landlord to insure that the landlord either enforces the lease or terminates the tenancy.
HACA is responsible for insuring that the Section 8 family does not violate the family obligations set out in the HCVP Voucher and the HACA Obligations of the Family form. When HACA receives creditable information that a Section 8 family may be violating one or more of these family obligations, HACA staff (which includes a District Attorney’s Office Deputy) investigates and follows up, as appropriate.
